11.9. Force Majeure. You acknowledge that Brian Tracy's servers, equipment, and services (e.g. tracking and reporting) may be subject to temporary modifications or shutdowns due to causes beyond Brian Tracy's reasonable control. Such temporary service interruptions will not constitute a material breach of this Agreement. BTI will use commercially reasonable efforts to provide the services contemplated under this Agreement and to remedy any temporary interruptions or other problems that adversely affect the Program.


For purposes of this Agreement, the Technology means the electronic access to programs, content and documentation, and Company's end user license agreement as it may be modified by Company for use in the Territory. The relationship between the corporate user and Company and/or its Affiliates shall be as specified in the applicable Company end user license agreement. Notwithstanding the foregoing, as between Company and MA, MA shall be responsible as defined for providing customer and technical support to end users in the Territory. MA will notify Company immediately in the event that it is unable to respond effectively to any end users’ requests.
It’s quite amazing how I keep stumbling on fresh information every day even with my expertise. This is indeed a great piece! Marketing Plan. MA shall submit an annual marketing plan to Company outlining, among other things, activities and staffing directed at attaining mutually agreed upon annual sales quotas. The Annual Quota is defined in Schedule A of this Agreement. The annual marketing plan shall be devised solely by MA and MA shall not be required to follow an operating plan, standard procedure, training manual, or its substantial equivalent, published by Company.

For example, if an app developer gave you their 99-cent app for free for you to review it, that information might not have much effect on the weight that readers give to your review. But if the app developer also gave you $100, knowledge of that payment would have a much greater effect on the credibility of your review. So a disclosure that simply said you got the app for free wouldn’t be good enough, but as discussed above, you don’t have to disclose exactly how much you were paid.


You still need to make a profit, so your products’ prices should benefit you, too. You’ll need to find a balance between affordable for the consumer and profitable for you. A good way to do this is to look up not just the customer price, but also the affiliate commission for your product category. You can learn more about your potential commission on Amazon.
You will market Local Associates Products to Amazon customers only at those locations and through those methods by which you customarily conduct your registered business. Solely with respect to the Local Associates Program, and notwithstanding anything to the contrary in the Participation Requirements, you may include Special Links in written physical and digital materials (including email) which are displayed, distributed, emailed, or offered to customers, clients, or third parties with whom you have a preexisting relationship; provided, that such written physical and digital materials are in compliance with the Associates Program Operating Agreement, the Trademark Guidelines, and the Amazon Brand Usage Guidelines. Upon our request, you will provide us with representative sample materials and written certification that you have complied with the foregoing. We will specify the form of, and content required in, that certification in any such request. Any failure by you to provide the certification in accordance with our request will constitute a material breach of this Local Associates Policy. For the avoidance of doubt, (i) for the purposes of the CAN-SPAM Act of 2003 and any similar or successor legislation (CAN-SPAM), you are the “Sender” of each email containing any Special Links, (ii) for the purposes of the Communications Act of 1934 as amended by Telephone Consumer Protection Act of 1991 and any similar or successor legislation (TCPA), you “make” and “initiate” each text message containing any Special Links, and (iii) you must comply with CAN-SPAM, TCPA and marketing industry standards and best practices for all emails, texts, and other messages relating to the Local Associates Program. Amazon may revoke the offline marketing permissions granted in this Section 3 at any time in its sole discretion by providing written notice to you.
You shall not create, publish, transmit or distribute, under any circumstances, any bulk email messages (also known as "SPAM") without prior written consent from FatCow, to be granted or denied in FatCow’s sole discretion, in each instance. Additionally, you may only send emails containing a FatCow affiliate link and or a message regarding FatCow or FatCow's Affiliate Program to people who have previously consented to receiving such communications from you. Your failure to abide by this Section 14, the CAN-SPAM Act of 2003, our Anti-Spam Policy, and all applicable laws relating to email communications, in any manner, will be deemed a material breach of this Agreement by you and will result in the forfeiture by you of any and all rights you may have to any commissions and the termination of your participation in the Affiliate Program. Further, if your account has excessive clicks in a very short period of time as determined by FatCow in its sole discretion, the Affiliate relationship may be terminated.
No. What matters is effective communication. A disclosure like “Company X gave me [name of product], and I think it’s great” gives your readers the information they need. Or, at the start of a short video, you might say, “The products I’m going to use in this video were given to me by their manufacturers.” That gives the necessary heads-up to your viewers.
20.3 Endorsements: Every endorsement, including testimonial, published by Affiliate regarding us or any of our products or services must be truthful, substantiated, and be neither deceptive nor unfair, as required by the Federal Trade Commission’s Guides Concerning Use of Endorsements and Testimonials in Advertising (16 Code of Federal Regulations Part 255) as now or hereafter amended. An endorsement is an advertising message that your readers are likely to believe reflects any opinion, belief, finding or experience of Affiliate and/or any other individual, expert, or organization other than us, even if those views are identical to ours. If Affiliate is then publishing a banner ad that advertises us, no further notice of the material connection between Affiliate and us is required. If Affiliate is not then publishing such banner ad, and publishes any endorsement of us or any of our products or services, Affiliate must publish notice to your readers that Affiliate may receive compensation from us. Affiliate must promptly notify us each time Affiliate is going to publish, or is publishing, an endorsement regarding us or any of our products or services. If we believe any endorsement does not comply with the FTC Guides, we reserve the right to require Affiliate to promptly bring the endorsement into compliance with the FTC Guides or immediately delete the endorsement(s). If Affiliate violates this provision Affiliate shall thereby forfeit any commissions earned from us and shall return all such commissions to us
The FTC isn’t mandating the specific wording of disclosures. However, the same general principle – that people get the information they need to evaluate sponsored statements – applies across the board, regardless of the advertising medium. The words “Sponsored” and “Promotion” use only 9 characters. “Paid ad” only uses 7 characters. Starting a tweet with “Ad:” or “#ad” – which takes only 3 characters – would likely be effective.

The Program Operator will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate system sale tracking failures, commission processing system failures, losses of database files or backups thereof, attacks on computing resources, computer viruses, the continued viability of their products, any results of “intents of harm” to the program, or acts of God or Nature. The Program Operator makes no claim that the operation of the websites or the Program Operator network will be error-free nor will the Program Operator be held liable for any interruptions or errors.
One of the ways I’ve also been able to make good money with Amazon is to automatically populate information from a WordPress plugin that I had developed based on the needs I had for building Amazon centric websites. The result was EasyAzon. The plugin allows you to insert information and affiliate links to Amazon in a much faster way than creating the links yourself by hand from Amazon.com.

We will evaluate your application in good faith and will notify you of your acceptance or rejection in a timely manner. We may reject your application if we determine (in our sole discretion) that your website is not suitable for the Affiliate Program for any reason, including, but not limited to, its inclusion of content that is, in our opinion, unlawful or otherwise violates our Acceptable Use Policy.
[Sender.Company] is a proven leader in affiliate marketing. We have a track record of optimizing our clients’ current affiliate platform to help them realize an average increase in clicks, conversions, revenue, and average order value. Our affiliate strategy is tailored for each client depending on the goals set forth by the client and include a combination of publisher recruitment and commission optimization.

For example, say you get 1,000 visitors to your site each day. If your conversion rate is 1 percent, then that means 10 of those visitors will end up purchasing something you recommended. If the average commission you receive is $5, then that means each day you'll earn 10 * $5 = $50 on average. This gives you an idea of what you can do to improve your affiliate business. To grow from this point, you can either work to increase the number of readers you have or you can work at increasing your conversion rate.
2. Commissions – John writes that he’s not satisfied with a 4% commission. He’s right in some ways, 4% isn’t that much when you’re selling a $10 book – however when you’re selling a Get a Price on the $5000 Camera or a $25,000 Tractor (I know someone who does quite well out of ride on mowers and tractors) it certainly adds up. Not only that, the 4% rate that John talks about is the base rate. Unfortunately it is as high as it goes on consumer electronics – however on most other products there is a sliding scale where the more you sell the higher your commission goes to. Sell more than 6 items in a month and your commission goes to 6% – sell over 630 and you’re up to 8% (the rate I’m on). The 4-Hour work Week that John uses as an example earned me around $1 a book. Still not a lot – but I did sell 100 or so of them (after my interview with it’s author) which not only earned me $100 but also helped push the numbers of sales up for the month, moving me into the next earning bracket.
He also started attending the three-times-a-year Affiliate Summit marketing conference and other trade shows. “You’d be surprised at how much of a relationship business this is,” he said. “There are thousands upon thousands of affiliates out there, but you come to realize that a lot of the good ones all seem to know each other and there’s as much suspicion of merchants cheating affiliates out of commissions as the other way around.”
This agreement shall begin upon the date of its execution by MA and acceptance in writing by Company and shall remain in effect until the end of the current calendar year and shall be automatically renewed for successive one (1) year periods unless otherwise terminated according to the cancellation or termination provisions contained in paragraph 18 of this Agreement. Company and MA acknowledge that this Agreement is not a franchise as that term is defined under any and all applicable local, state and/or federal laws in U.S., as amended.
The affiliate marketing industry is somewhat unique in the transparency of many of its members. There’s a general willingness to share experiences, including both successes and failures. Whether there should be any disclosure depends upon whether the “like” or “share” could be viewed as an advertisement for your company. If the post is an ad, then employees endorsing the post should disclose their relationship to the company. With a share, that’s fairly easy to do, “Check out my company’s great new product ….” Regarding “likes,” see what we said above about “likes.” 

Their policies are strict. Be sure to read through Amazon’s affiliate program policies very carefully. Any violation of their policies is grounds for account suspension--something which could be devastating if you build an entire website or store around affiliate links. Amazon has also been known to suspend accounts without any prior notice, so tread carefully.
d) To the extent you have in any manner violated or threatened to violate the Program Operator’s intellectual property rights, the Program Operator may seek injunctive or other appropriate relief in any court located in Anchorage, AK, USA and you consent to exclusive jurisdiction and venue in such courts. Use of the Program Operator website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and the Program Operator as a result of this agreement or use of the website, products, and/or services. The Program Operator’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of the Program Operator’s right to comply with governmental, court and law enforcement determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

You Don’t Need To Track Affiliate Links To Improve Conversions – you will always hear people telling you to track affiliate links. But for me, I generally use the same content about SiteGround on all my speed optimization articles… it is very important it converts well. Change your approach on how you recommend your affiliate product (it’s perfecting your sales pitch).
Once you’ve set up your account, do note that Amazon requires you to use product links and generate income from at least three of them within 180 days. If you fail to do so within that time, they will close your account. If you are able to satisfy that requirement, Amazon will review your account as well as your usage of affiliate links once the first sale is complete.
SEO: getting consistent traffic by writing AWESOME content about your keywords (there’s a phrase “length is strength” in SEO and this paid off big time for me). Maybe you’re doing videos or an eCourse, but I found blog posts WAY easier to update which means less maintenance. The biggest factor by FAR was the time I spent meticulously creating my tutorials… which eventually resulted in a sudden 3x increase in SEO traffic
Companies online will give you a commission if you refer a customer to them. An easy example would be with Amazon. Amazon has an affiliate program called Amazon Associates. It’s free to join and takes just a couple minutes to set up. From there you can search every product that is on Amazon and get your personal referral link. Let’s say your friend mentioned they wanted a new TV. You could send them your referral link for a TV on Amazon. Your friend buys the TV for $500, and Amazon gives you 6% of that sale. That means you made $30 without doing anything. Pretty cool, huh?

The email they sent to affiliates said, "We have received feedback from associates that the advertising fee structure could be made clearer, especially with respect to understanding which products are in fixed-fee categories and which products are in tiered-fee categories. This could leave many once competitive niches with a lot more gaps for you to build and leverage into with your niche sites. While we don’t believe we’ll see a mass exodus from Amazon Associates (Even with the currently grumbling about the changes online), some niches may be more affected by this than others so it may pay to look for gaps in the market.

(d) Local Associate Consent. By accepting this Local Associates Policy, you hereby grant to Amazon a non-exclusive, irrevocable, worldwide, fully paid-up, royalty-free and perpetual license in all languages to use, copy, reproduce, adapt, distribute, transmit and display your name, photo, logo and other trademarks or materials provided to Amazon in connection with the Local Associates Program (“Local Associate Marks”), solely in connection with the promotion, use, and display of the Recommendation Page and as examples of best practices in our educational and marketing materials; provided however, that Amazon will not alter any Local Associate Marks from the form provided by you (except to re-format or re-size within the Recommendation Page, so long as the relative presentation of the Local Associate Marks remains the same).
You will register for and be assigned a unique URL associated with an Associate ID for your participation in the Local Associates Program. You will not use any alternative URL or Associate IDs in connection with the Local Associates Program or use the assigned URL or Associate ID for any other purpose. For purposes of this Local Associates Policy, your unique URL will be considered a Special Link as defined in the Associates Program Operating Agreement.
Not necessarily. Just because a platform offers a feature like that is no guarantee it’s an effective way for influencers to disclose their material connection to a brand. It still depends on an evaluation of whether the tool clearly and conspicuously discloses the relevant connection. One factor the FTC will look to is placement. The disclosure should catch users’ attention and be placed where they aren’t likely to miss it. A key consideration is how users view the screen when using a particular platform. For example, on a photo platform, users paging through their streams will likely look at the eye-catching images. Therefore, a disclosure placed above a photo may not attract their attention. Similarly, a disclosure in the lower corner of a video could be too easy for users to overlook. Second, the disclosure should use a simple-to-read font with a contrasting background that makes it stand out. Third, the disclosure should be a worded in a way that’s understandable to the ordinary reader. Ambiguous phrases are likely to be confusing. For example, simply flagging that a post contains paid content might not be sufficient if the post mentions multiple brands and not all of the mentions were paid. The big-picture point is that the ultimate responsibility for clearly disclosing a material connection rests with the influencer and the brand – not the platform.

While every affiliate program is different, you are less likely to be hit by a ban hammer in the affiliate space than in the Adsense space.  In general, affiliate networks can be a bit more lenient with their terms of services. You also have the benefit that many networks are hosting the same offers, so if one does ban you, you can usually replace that income with the new network offer.
