General Rights. Subject to the terms and conditions of this Agreement, Company hereby grants to MA the right to advertise, market and sell to corporate users, government agencies and educational facilities (“Clients”) for their own internal language learning, soft skills and communication purposes only, and not for remarketing or redistribution, and not for use in a data center environment for multiple users Clients, unless otherwise agreed to by Company prior in writing, the Technology listed in Schedule A of this Agreement, and to sell and/or bundle Technology Maintenance for the Technology and to provide first line technical support and implementation services for the Technology in the territories listed in Schedule A of this Agreement, providing MA meets the criteria required for delivering services according to Schedule A.
It is the intent of FatCow to treat all of our customers fairly. Accordingly, we require all FatCow Affiliates to comply with applicable laws, regulations and guidelines concerning advertising and marketing, including without limitation, the Federal Trade Commission (FTC) Endorsement Guides, which require that material connections between advertisers and endorsers be disclosed. This means that all Affiliate Sites (e.g. directories, review/rating websites, blogs, and other websites) and any email or collateral that provide an endorsement or assessment of FatCow’s Products and Services must prominently disclose the fact that you receive compensation for Referred Customers.

This Agreement contains the entire agreement between the parties, and no representations, statements or inducements, oral or written, not contained herein, shall be binding upon the parties. Company expressly disclaims the making of, and MA acknowledges that it has not received a warranty or guaranty, express or implied, as to the potential volume, profits or success of the business venture contemplated by this Agreement. 

You will market Local Associates Products to Amazon customers only at those locations and through those methods by which you customarily conduct your registered business. Solely with respect to the Local Associates Program, and notwithstanding anything to the contrary in the Participation Requirements, you may include Special Links in written physical and digital materials (including email) which are displayed, distributed, emailed, or offered to customers, clients, or third parties with whom you have a preexisting relationship; provided, that such written physical and digital materials are in compliance with the Associates Program Operating Agreement, the Trademark Guidelines, and the Amazon Brand Usage Guidelines. Upon our request, you will provide us with representative sample materials and written certification that you have complied with the foregoing. We will specify the form of, and content required in, that certification in any such request. Any failure by you to provide the certification in accordance with our request will constitute a material breach of this Local Associates Policy. For the avoidance of doubt, (i) for the purposes of the CAN-SPAM Act of 2003 and any similar or successor legislation (CAN-SPAM), you are the “Sender” of each email containing any Special Links, (ii) for the purposes of the Communications Act of 1934 as amended by Telephone Consumer Protection Act of 1991 and any similar or successor legislation (TCPA), you “make” and “initiate” each text message containing any Special Links, and (iii) you must comply with CAN-SPAM, TCPA and marketing industry standards and best practices for all emails, texts, and other messages relating to the Local Associates Program. Amazon may revoke the offline marketing permissions granted in this Section 3 at any time in its sole discretion by providing written notice to you.

Back when text link ads were a big deal, I remember seeing every single “make money online” website with a 125 x 125 pixel advertisement for Text Link Ads, which was an older advertising model where you could have advertisers pay for having specific terms on your website become links to their products. This was big in the blogosphere when I was just starting out. Most of these sites did not actually use the text link ad service on their own sites. You can also use WP Rich Snippets to allow people to leave a review about the product/service on your site and get those review stars in Google (you will want to use their front end submit add-on).
Amazon has already made similar adjustments in many overseas markets. A lot of people make money through it, some even make a very good living off of it. Learning how to get started with affiliate marketing can be easily done. Now, I am going to assume you know a thing or two about affiliate marketing and are ready – nay, eager! – to get started. (a) For purposes of the Local Associates Program, “your Site”, as referenced in the Associates Program Operating Agreement, includes the Local Associates Facilities and any other location where you market Products to Amazon customers. As used herein, “Confidential Information” means all confidential information disclosed by a party ("Disclosing Party") to the other party (“Receiving Party”), (i) whether orally or in writing, that is designated as confidential, and (ii) HubSpot customer and prospect information, whether or not otherwise designated as confidential. The Receiving Party may disclose Confidential Information of the Disclosing Party if required to do so under any federal, state, or local law, statute, rule or regulation, subpoena or legal process.
Theme – you don’t need a special theme for affiliate marketing, you probably just need a blog. I recommend StudioPress themes since that’s what Yoast, Matt Cutts (from Google), and I use. Matt Mullenweg, founder of WordPress also recommends them. One of the biggest mistakes I made was using a theme from Themeforest… since they’re built by independent developers who may stop making updates to their theme. This happened to me and I hear horror stories all the time about people having to switch themes and redesign their entire site. I’ve been using the same StudioPress theme (Outreach Pro) for 3 years. Their themes are lightweight (load fast), SEO-friendly via optimized code, secure, and they have a huge selection of plugins for the Genesis Framework and an awesome community in the Genesis WordPress Facebook Group. They include documentation for setting it up and will serve you for many, many years.
No. What matters is whether the information would have an effect on the weight readers would give your review. So whether you got $100 or $1,000 you could simply say you were “paid.” (That wouldn’t be good enough, however, if you’re an employee or co-owner.) And if it is something so small that it would not affect the weight readers would give your review, you may not need to disclose anything.

Your company is ultimately responsible for what others do on your behalf. You should make sure your public relations firm has an appropriate program in place to train and monitor members of its social media network. Ask for regular reports confirming that the program is operating properly and monitor the network periodically. Delegating part of your promotional program to an outside entity doesn’t relieve you of responsibility under the FTC Act.
I thought I would just bring something else to your attention; I did take a second to look at your site; you know why I left within just one second? EXACTLY! You have less then 3 seconds to make your first impression on visitors; if your visitors are bouncing off your site at the speed of light, they either found your site by mistake, or they were not impressed with your site, and left, which means? right, they did not trust your site!!! What happens if you have a high bounce rate? right, you can certainly lose rankings! Is google going to keep sending you traffic if you have nothing to offer? nope! I can not say this is your problem, or you could have multiple problems going on at the same time to cause you to lose rankings. I can tell you one thing for sure by just taking a 1 minute look at your link profile; You have quite a few links, and you have almost no authority, what does this mean? This most likely means you are spamming your link to poor quality sites. You also have a massive amount of do-follow links which does not look natural vs your no follow links, and with your site having low trust flow, do you think your site deserves that many do-follow links? I wonder what google thinks? at first glance, your anchor/link diversity does not look to bad, so your anchor/text does not look over-optimized, but whoever is building links for you, consider firing them immediately, as you are getting all the wrong links. I am going to assume at this point google has certainly given you a penalty; Your next move to to hire someone to audit your site, and start disavowing/removing bad links from your portfolio, over time, your rankings may come back, and that may depend on other factors also, but at this point, it certainly looks like you have link issues. Just a little bitty research goes a long way. good luck.
You shouldn’t forget the term ‘affiliate’, what really means it in an article marketing campaign. These strategic buys can lead to new insightful data as well. You will see other products within your niche that the audience is prone to buy, which can help you in deciding to launch your next product. Also, each of these sites can become little satellite sites that can collect emails for your overall brand. Cost per action/sale methods require that referred visitors do more than visit the advertiser's website before the affiliate receives a commission. The advertiser must convert that visitor first. It is in the best interest of the affiliate to send the most closely targeted traffic to the advertiser as possible to increase the chance of a conversion. The risk and loss are shared between the affiliate and the advertiser.

Meeting the standard can be complicated enough if you are running direct linking campaigns as an affiliate. It becomes even more complex if you are building an email list or running another complex funnel that requires you to collect personal information. Make sure you have a simple way of collecting data reports and deletion requests so you can respond in a timely manner.

FatCow’s Terms and Conditions, rules, policies, and operating procedures will apply to such customers. We may change our policies, pricing, and operating procedures at any time. You're going to be doing product reviews and recommendations, so pick a topic that you enjoy and about which you can demonstrate some expertise. Choose a narrow enough niche to be distinctive—for example, bands from your city, left-handed guitarists, music for a certain kind of dancing, authors of a certain religion, books about business, or arts and crafts resources. 8.1. You are free to promote your own web sites, but naturally any promotion that mentions Merchant.com could be perceived by the public or the press as a joint effort. You should know that certain forms of advertising are always prohibited by Merchant.com. For example, advertising commonly referred to as "spamming" is unacceptable to us and could cause damage to our name. Other generally prohibited forms of advertising include the use of unsolicited commercial email (UCE), postings to non-commercial newsgroups and cross-posting to multiple newsgroups at once. In addition, you may not advertise in any way that effectively conceals or misrepresents your identity, your domain name, or your return email address. You may use mailings to customers to promote Merchant.com so long as the recipient is already a customer or subscriber of your services or web site, and recipients have the option to remove themselves from future mailings. Also, you may post to newsgroups to promote Merchant.com so long as the news group specifically welcomes commercial messages. At all times, you must clearly represent yourself and your web sites as independent from Merchant.com. If it comes to our attention that you are spamming, we will consider that cause for immediate termination of this Agreement and your participation in the Merchant.com Affiliate Program. Any pending balances owed to you will not be paid if your account is terminated due to such unacceptable advertising or solicitation.

9.2. Each party agrees not to use the other's proprietary materials in any manner that is disparaging, misleading, obscene or that otherwise portrays the party in a negative light. Each party reserves all of its respective rights in the proprietary materials covered by this license. Other than the license granted in this Agreement, each party retains all right, title, and interest to its respective rights and no right, title, or interest is transferred to the other.


Moreover, employees of an ad agency or public relations firm have a connection to the advertiser, which should be disclosed in all social media posts. Agencies asking their employees to spread the word must instruct those employees about their responsibilities to disclose their relationship to the product they are endorsing, e.g., “My employer is paid to promote [name of product],” or simply “Advertisement,” or when space is an issue, “Ad” or “#ad.”
Marketing Plan. MA shall submit an annual marketing plan to Company outlining, among other things, activities and staffing directed at attaining mutually agreed upon annual sales quotas. The Annual Quota is defined in Schedule A of this Agreement. The annual marketing plan shall be devised solely by MA and MA shall not be required to follow an operating plan, standard procedure, training manual, or its substantial equivalent, published by Company.

You’ve raised two issues here. First, it may be relevant to readers that people endorsing your restaurant on social media are related to you. Therefore, they should disclose that personal relationship. Second, if you are giving free meals to anyone and seeking their endorsement, then their reviews in social media would be viewed as advertising subject to FTC jurisdiction. But even if you don’t specifically ask for their endorsement, there may be an expectation that attendees will spread the word about the restaurant. Therefore, if someone who eats for free at your invitation posts about your restaurant, readers of the post would probably want to know that the meal was on the house.

If you want to find a way to be able to mention products that are on sale more frequently on your website one of the easiest ways I’ve done that in the past is to just do a weekly deals post. So what I’ll do is publish a post every week with the best deals for my niche and then incorporate all of the previous tactics I’ve discussed above to link to the products on Amazon.com. Depending on how often you publish articles you could do it more or less frequently (I’ve seen some websites do these style of articles every day).

You shall not create, publish, transmit or distribute, under any circumstances, any bulk email messages (also known as "SPAM") without prior written consent from FatCow, to be granted or denied in FatCow’s sole discretion, in each instance. Additionally, you may only send emails containing a FatCow affiliate link and or a message regarding FatCow or FatCow's Affiliate Program to people who have previously consented to receiving such communications from you. Your failure to abide by this Section 14, the CAN-SPAM Act of 2003, our Anti-Spam Policy, and all applicable laws relating to email communications, in any manner, will be deemed a material breach of this Agreement by you and will result in the forfeiture by you of any and all rights you may have to any commissions and the termination of your participation in the Affiliate Program. Further, if your account has excessive clicks in a very short period of time as determined by FatCow in its sole discretion, the Affiliate relationship may be terminated.
(b) The Local Associates Products will be made available for Amazon customers to purchase through a specific page on Amazon.com assigned to each Local Associate (such page, the “Recommendations Page”). The Recommendations Page will include either a general Amazon.com search bar or a selection of Local Associates Products curated by you. Amazon reserves the right to modify the Products included in the Local Associates Products on any Recommendations Page. You must direct all Local Associates Program marketing to the Recommendations Page to be eligible for Qualified Purchases.
Special Links may be created by you or made available to you by us. If we inform you that your Site does not qualify to use certain types of links, you must cease displaying those types of links on your Site. You are solely responsible for the content, style, and placement of each link that you place on your Site and for ensuring that Special Links (whether created by you or made available to you by us) include the appropriate formatting necessary for us to properly track referrals of our customers from your Site. You must not encourage customers to bookmark your Special Links. All Special Links must be accessed directly from your Site. For example, you must include your Associates ID or “tag” (appearing as XXXXX-20, or such other format as we may designate) as a parameter in the URL of each link you place on your Site to an Amazon Site.
It depends on whether his followers understand that he’s being paid to endorse that product. If they know he’s a paid endorser, no disclosure is needed. But if a significant portion of his followers don’t know that, the relationship should be disclosed. Determining whether followers are aware of a relationship could be tricky in many cases, so we recommend disclosure. 

Who can tell me if “link masking or cloaking” is a violation of the Google TOS? I think it is and I see dozens of affiliate sites doing it. I also see quite a few sites not using “nofollow” on their affiliate links. Unless your masked link says something like “I bought product X used in this review at Amazon.com” it would be a violation. I think if reported, you’d be in for a manual spam action against your site. Thoughts?

(b) Influencer Page. This Influencer Program may include an Amazon Site influencer page registered through Amazon and assigned to you (“Influencer Page”). With respect to Special Links that direct customers to your Influencer Page, the related Session will be measured as beginning when our customer clicks through to your Influencer Page. The Influencer Page is a “Service Offering” for all purposes under the Agreement. With respect to any text, pictures, compilations, lists, comments or other data or content you submit to Amazon in connection with the Influencer Program (“Influencer Content”), you will not submit such Influencer Content if it violates any standard included in Section 1 of the Participation Requirements.

This License governs your use of Program Content in connection with your participation in the Associates Program. By accepting the Agreement, or by accessing or using the Program Content, including the proprietary application programming interfaces and other tools (collectively, the “PA API”) that permit you to access and use certain types of data, images, text, and other information and content relating to Products (“Product Advertising Content”) which we may make available to you, you agree to be bound by this License.
To build trust, you need to create content that’s honest and sounds natural.
